Terms of Service

1. Acceptance of Terms

By accessing or using the KBForge platform, API, website, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Service Description

KBForge is a developer-first knowledge base platform designed for AI and LLM applications. The Service enables users to:

  • Upload and store documents in managed knowledge bases
  • Organize content using segments and tags
  • Retrieve semantically relevant context via the retrieve() API for integration with AI/LLM workflows
  • Process documents using vector embeddings powered by Gemini and pgvector

KBForge reserves the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

3. User Accounts & Responsibilities

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials and API keys
  • All activity that occurs under your account, whether authorized or not
  • Notifying KBForge immediately of any unauthorized use of your account
  • Ensuring that your use of the Service complies with all applicable laws and regulations

You must be at least 18 years of age to create an account. KBForge reserves the right to suspend or terminate accounts that violate these Terms or that remain inactive for an extended period.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Upload, store, or transmit any content that is unlawful, harmful, threatening, defamatory, or otherwise objectionable
  • Violate any intellectual property rights, privacy rights, or other rights of any third party
  • Distribute malware, viruses, or any other malicious code
  • Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to build a competing product or service
  • Engage in any activity that interferes with or disrupts the Service or its infrastructure
  • Resell, sublicense, or redistribute access to the Service without prior written consent

KBForge reserves the right to remove any content and suspend or terminate any account that violates this Acceptable Use Policy, at its sole discretion and without prior notice.

5. API Usage & Rate Limits

Access to the KBForge API is subject to rate limits and usage quotas that vary by plan:

  • Free ($0/mo): Subject to baseline rate limits and storage quotas as documented
  • Pro ($49/mo): Higher rate limits, increased storage, and priority processing
  • Enterprise ($199/mo): Custom rate limits, dedicated support, and SLA guarantees

You agree to adhere to the rate limits and usage quotas applicable to your plan. KBForge may throttle or temporarily block API requests that exceed your allocated limits. Sustained or abusive overuse may result in account suspension. Current rate limits and quotas are published in the API documentation and may be updated from time to time.

6. Intellectual Property

The Service, including its software, design, logos, trademarks, documentation, and all related intellectual property, is and remains the exclusive property of KBForge. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service, unless applicable law expressly permits it.

7. Data Ownership

You retain full ownership of all data, documents, and content you upload to the Service (“User Data”). KBForge does not claim any ownership rights over your User Data.

By using the Service, you grant KBForge a limited, non-exclusive, worldwide license to process, store, and index your User Data solely for the purpose of providing and improving the Service. This license terminates when you delete your User Data or close your account.

KBForge will not sell, share, or use your User Data for advertising purposes. You may export or delete your User Data at any time through the Service or by contacting support. Upon account termination, KBForge will delete your User Data within 30 days, unless retention is required by law.

8. Payment Terms & Billing

Paid plans (Pro and Enterprise) are billed on a monthly recurring basis. By subscribing to a paid plan, you authorize KBForge to charge your designated payment method at the beginning of each billing cycle.

  • All fees are quoted in US Dollars (USD) and are non-refundable, except as required by applicable law
  • Plan upgrades take effect immediately; downgrades take effect at the start of the next billing cycle
  • KBForge reserves the right to change pricing with at least 30 days' prior written notice
  • Failure to pay may result in suspension or termination of your account
  • You are responsible for any applicable taxes associated with your use of the Service

9. Service Availability & SLA

KBForge strives to maintain high availability of the Service. However, the Service is provided on an “as is” and “as available” basis. KBForge does not guarantee uninterrupted or error-free operation.

Enterprise plan subscribers are eligible for a Service Level Agreement (SLA) with a target uptime of 99.9%. If KBForge fails to meet the SLA commitment, eligible customers may request service credits as described in the Enterprise SLA documentation.

Scheduled maintenance windows will be communicated in advance. KBForge is not liable for downtime caused by factors outside its reasonable control, including but not limited to force majeure events, third-party service outages, or network failures.

10. Limitation of Liability

To the maximum extent permitted by applicable law, KBForge and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the Service.

In no event shall KBForge's total aggregate liability exceed the greater of (a) the amount you paid to KBForge in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

KBForge does not warrant that the Service will meet your specific requirements, that results obtained from the Service will be accurate or reliable, or that any errors in the Service will be corrected.

11. Termination

You may terminate your account at any time by contacting support or using the account settings in the Service. Upon termination:

  • Your right to access and use the Service will cease immediately
  • Any outstanding fees owed to KBForge become immediately due and payable
  • KBForge will delete your User Data within 30 days, unless retention is required by law

KBForge may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. In the event of termination for cause (such as a violation of these Terms), no refund will be issued. In the event of termination without cause, KBForge will provide a pro-rated refund for any prepaid, unused portion of the current billing cycle.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

You agree to waive any right to a jury trial in connection with any action or litigation arising under these Terms. Any claim or cause of action arising out of or related to the Service must be filed within one (1) year after the cause of action arose, or be permanently barred.

13. Modifications to Terms

KBForge reserves the right to update or modify these Terms at any time. When material changes are made, we will notify you by posting the updated Terms on this page and updating the “Last Updated” date at the top.

For material changes that affect your rights or obligations, we will make reasonable efforts to provide advance notice via email or an in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
